Interim Injunction after Violation of Indian Arbitration Clause
On 20th August 2024, the Delhi High Court (Honasa Consumer Limited v. RSM General Trading LLC) granted an Indian company interim relief against its former distributor in Dubai, who had obtained a judgment for damages in the courts of Dubai. The distribution agreement provided i.a. for the application of Indian law, arbitration and the exclusive jurisdiction of the courts of Delhi. Still, the distributor sued the principal in Dubai. The Indian company petitioned the Delhi High Court to bar the distributor from the execution of the judgment, successfully. The High Court ruled the actions of the distributor “one of the worst instances of abuse of the legal process.” It remains to be seen how effective the injunction is going to be.

Important Update for Visa Applications in Malaysia
In Malaysia, it’s common for visa applications to be returned for improvement—usually to submit additional documents. The Expatriate Services Division (ESD) calls this a "returned application."
In practice, this has often resulted in improvements being returned only after weeks or even months. But starting October 1, 2024, that will no longer be possible:
All returned applications in ESD Online that are not improved within 90 days will be automatically deleted! This update also affects currently pending applications. While ESD has assured that there will be several warnings to prevent sudden cancellations, caution is advised! If an application needs to be completely resubmitted, it may lead to delays of several months.
